On June 27, 2023, the U.S. Department of Health and Human Services Office of Inspector General (HHS/OIG) finalized its rule implementing civil monetary penalties for information blocking (IB), as authorized by the 21st Century Cures Act. This new resource provides further information, suggestions and resources regarding IB penalties.
The federal information blocking rules apply to certain actor types and are enforced by the U.S. Department of Health and Human Services. However, state governments and courts have also been active in creating policy and addressing litigation related to information blocking. This webpage identifies those state-level activities and provides link to additional resources.
